Tlus issue toeuses on pipeline safety. That's not to say
pipeline safety isn't important year around or that other buried utilities aren't important. They
are, but pipeline safety has received a lot of national attention. and even in west Virginia we've
seen the rlestruetion caused by a lack of understanding and respect tor pipelines.

Additionally we've included a letter from the Plpeline and Hazardous Materials satety
Administration (PHMSA) addressed to the zxcavatlng community in west Virginia. If you

are an excavate: or zxcavatlng in our state. you need to know there are requirements placed

on you from a tederal level. You should know that "Excavators who fall to comply with these
requirements may be subject to civil penalties not to exceed $205,638 tor each violation tor each
day the violation continues, except that the maximum administrative civil penalty may not
exceed $2,056,380 tor any related sei-ies of violations.”
